A lawsuit filed today with the Arizona Supreme Court challenges Gov. Jan Brewer's plan to cut Medicaid programs and in the process eliminate health care coverage for thousands of Arizonans. The lawsuit calls the cuts unconstitutional, arguing that the cuts violate a 2000 voter approved referendum, Prop 204, that conferred health care coverage to the poorest adults and children in Arizona.
The Special Action Complaint was filed on behalf of four Arizonans who currently receive Medicaid benefits. The Complaint, alleges that Gov. Brewer's proposed cuts are in direct violation of Prop 204, which guaranteed health benefits for all Arizonans who earn less tan 100% of the federal poverty guideline wage.
Gov. Brewer's proposed cuts that are the subject of this suit would eliminate coverage for approximately 250,000 individuals and save the State and expected $210 Million.
It is expected that the Supreme Court will decide today or tomorrow whether to hear the case.
