McCarthy v. USAA – $352,731 Arbitration Award.

Our client was a 16 year old girl belted in the back seat of her mom's minivan on the way to soccer practice when another driver ran a red light and struck their vehicle. The force of the collision blew out the car door window, cutting her face. She was left with scars around the right side of her mouth, extending down towards her jawline. We resolved the case against the adverse driver for the insurance policy limits of $250,000.
We then made a policy limits demand against our client's own first party, underinsured motorist coverage. USAA, the insurance company initially denied the demand and offered nothing. We proceeded to arbitration, and on the eve of the hearing, USAA offered $10,000.
The arbitration award was for $385,000. Post award, we negotiated with USAA to pay the entire arbitration award, including expenses and expert fees.
